1. About Our Service
Cleanseenergy Walking Club provides general lifestyle information about group walks, route planning, Everyday Movement through walking, social community outings, mindful movement, and eco-friendly travel in and around Wellington. We publish a walk calendar, meeting-point details, and educational articles intended for a general audience interested in outdoor activity and community walking.
We are a voluntary community organisation, not a registered medical provider, fitness certification body, or professional advisory service.
2. Governing Law and Jurisdiction
These Terms are governed by the laws of New Zealand, including but not limited to:
- The Contract and Commercial Law Act 2017
- The Fair Trading Act 1986
- The Consumer Guarantees Act 1993 (where applicable to services we provide to consumers in trade)
- The Privacy Act 2020
- The Harmful Digital Communications Act 2015
- The Health and Safety at Work Act 2015 (in relation to organised events and volunteer activities)
- The Copyright Act 1994
- The Unsolicited Electronic Messages Act 2007
By using this website, you agree to these Terms. Where the Electronic Transactions Act 2002 applies, your electronic acceptance (including submitting forms and using the site) has the same legal effect as a written agreement, subject to any mandatory consumer rights that cannot be excluded.
Any dispute arising from these Terms or your use of the website shall be subject to the non-exclusive jurisdiction of the courts of New Zealand. Consumers may also use dispute resolution avenues available under New Zealand law, including the Disputes Tribunal for eligible claims up to its monetary limit.
3. Content Disclaimer — Lifestyle Information Only
All content on this website — including articles about Everyday Movement, route descriptions, duration estimates, difficulty labels, safety tips, mindful walking guidance, and eco-travel suggestions — is provided for general lifestyle and informational purposes only.
Nothing on this site constitutes:
- Medical, health, or therapeutic advice
- Professional fitness or coaching instruction
- Legal, financial, or insurance advice
- A guarantee of specific health outcomes, fitness results, or environmental impact
Walking conditions in Wellington change with weather, trail maintenance, traffic, and seasonal factors. Route notes and calendar entries are approximate guides. You are responsible for assessing whether a walk is suitable for your personal circumstances before participating.
4. No Medical Claims
We do not make medical claims about walking or group exercise. References to research, energy levels, cardiovascular activity, stress management, or sleep quality are general summaries of publicly available information and are not promises of individual results.
Always consult a qualified healthcare professional before starting or changing any physical activity programme, especially if you have a medical condition, injury, pregnancy, or other health concern. Do not disregard professional medical advice because of something you read on this website.
Our disclaimer bar states: "This website provides general lifestyle information only and is not professional or medical advice. Cleanseenergy Walking Club is a voluntary community group in Wellington, New Zealand." This applies to every page on the site.
5. Fair Trading Act 1986
We are committed to honest and accurate communications under the Fair Trading Act 1986. We will not make false or misleading representations about:
- The nature, suitability, or benefits of walks and events we organise
- Membership fees, donations, or costs associated with participation
- Our qualifications, affiliations, or endorsements
- The accuracy of route times, terrain descriptions, or difficulty ratings
If you believe any content on this site is misleading, please contact us promptly at assist@cleanseenergy.world so we can review and correct it. You may also report concerns about misleading conduct to the Commerce Commission at comcom.govt.nz.
6. Health and Safety at Work Act 2015
We take reasonable steps to organise walks safely and communicate route hazards, weather cancellations, and meeting-point instructions. Walk leaders and volunteers act in a community capacity. Participants share responsibility for their own safety on public paths and open spaces.
Under New Zealand's Accident Compensation Act 2001, personal injuries caused by accidents in New Zealand are generally covered by the ACC no-fault scheme rather than civil litigation, subject to ACC eligibility rules. Nothing in these Terms limits ACC entitlements.
7. Event and Walk Participation — At Your Own Risk
Participation in group walks, community litter-pick outings, buddy-system events, and any other activities organised or promoted through this website is voluntary and at your own risk.
By joining a walk or event, you acknowledge that:
- Outdoor walking involves inherent risks including uneven surfaces, weather exposure, traffic near shared paths, hills, fatigue, and interaction with other pedestrians, cyclists, or wildlife
- Walk leaders and volunteers are community members providing informal guidance, not professional guides, and may not hold first-aid or rescue qualifications unless explicitly stated for a specific event
- You are responsible for your own footwear, hydration, clothing, fitness level, and decision to continue or leave a route
- Events may be cancelled, rescheduled, or rerouted due to weather, safety concerns, or low attendance
- Minors must be accompanied by a parent or legal guardian unless prior written consent is arranged with us
To the fullest extent permitted by New Zealand law, you agree to release and hold harmless Cleanseenergy Walking Club, its organisers, volunteers, and affiliates from claims arising from your participation, except where liability cannot be excluded by law (including under the Consumer Guarantees Act or for death or personal injury caused by our negligence where exclusion is prohibited).

Our website may link to external resources (for example, weather services, map embeds, or research publications). We do not control and are not responsible for third-party content, availability, or privacy practices. Links are provided for convenience and do not imply endorsement.
11. Limitation of Liability
To the maximum extent permitted by New Zealand law:
- The website and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under New Zealand law, including liability for fraud or for personal injury or death caused by negligence where such exclusion is unlawful.
12. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or your conduct at walks and events, except to the extent caused by our wilful misconduct or negligence.
13. Privacy, Cookies, and Electronic Messages
Your use of the website is also governed by our Privacy Policy, which explains how we handle personal information under the Privacy Act 2020 and GDPR where applicable. Our Cookie Policy describes how we use cookies and how you can manage preferences through our cookie banner (Accept All, Decline, or Cookie Settings).
We comply with the Unsolicited Electronic Messages Act 2007. We do not send commercial email or SMS marketing without consent, and every optional marketing message includes sender identification and an unsubscribe option.
